Terms of Service

Welcome to Screend. These Terms of Service ("Terms") govern your use of the Screend mobile application for iOS and Android ("the App"), the Screend website at screend.co ("the Website"), and any related services (together, "the Service"), operated by Screend ("we", "our", or "us").
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By creating an account, you confirm that you meet this age requirement. If we learn that a user is under 16, we will terminate their account and delete their data.
2. Your Account
You are responsible for maintaining the confidentiality and security of your account credentials. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at [email protected].
You may not:
- Create accounts for the purpose of impersonating another person or entity
- Create multiple accounts to circumvent restrictions or bans
- Share your account credentials with third parties
- Transfer your account to another person without our consent
3. User Content and License
3.1 Your ownership
You retain ownership of all content you create on the Service, including reviews, ratings, comments, recommendations, lists, and profile information ("User Content").
3.2 License you grant us
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and make available your User Content for the following purposes:
- Operating the Service and displaying your content to other users (in accordance with your account settings)
- Indexing, sorting, and generating metadata from your content
- Promoting the Service (for example, featuring a review on our social media channels, always with attribution to your username)
- Analyzing content for moderation, service improvement, and research purposes
This license continues for as long as your content remains on the Service. When you delete your content or your account, we will stop displaying it, subject to reasonable technical delays and any legal obligations to retain certain data.
3.3 Your responsibilities
You are solely responsible for your User Content. All content must be original or properly attributed. You must not post content that infringes anyone else's intellectual property or other legal rights.
4. Community Standards
Screend is a community for film, series, and anime enthusiasts. To maintain a safe and respectful environment, you agree not to post content that:
- Is unlawful, defamatory, harassing, threatening, or hateful
- Promotes hate, violence, or discrimination based on race, gender, gender identity, ethnicity, religion, disability, sexual orientation, or any other protected attribute
- Is sexually explicit or exploits minors in any way
- Impersonates another person or entity
- Contains spam, advertising, or unsolicited promotions
- Contains malicious links or attempts to deceive other users
- Manipulates ratings, reviews, or social features (e.g. fake reviews, mass follow/unfollow)
We reserve the right to remove any content that violates these standards, without prior notice. Repeated or severe violations may result in account suspension or termination.
If you see content that violates these standards, please report it using the in-app report feature or by emailing [email protected].
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service's systems or other users' accounts
- Use automated scripts, bots, scrapers, or other automated means to access the Service or collect data
- Interfere with the proper functioning of the Service or its infrastructure
- Collect or harvest personal data of other users without their consent
- Use the Service to distribute malware or harmful software
- Reverse engineer, disassemble, or decompile any part of the Service, except as permitted by applicable law
- Reproduce, duplicate, or copy any substantial portion of the Service's content (excluding your own content)
- Access the Service to build a competing product or service
- Probe, scan, or test the vulnerability of the Service or breach any security measures
6. Artist-Submitted Content
6.1 Artist submissions
Screend allows artists to submit original artworks (alternative posters, fan art, and other visual content) for display within the Service. All submissions are reviewed by our team before being published.
6.2 Artist license
By submitting artwork to Screend, you represent that you are the original creator of the work (or hold all necessary rights) and grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and use the artwork within the Service and in promotional materials related to the Service. You retain full ownership of your original work.
6.3 User interaction with artworks
Users may like artist artworks and, with an active Screend Pro subscription, select them as custom posters. Artist artworks remain attributed to their creators within the Service.
6.4 Takedown
Artists may request removal of their submitted works at any time by contacting [email protected]. We will remove the artwork within a reasonable timeframe.
7. Media Content
The Service displays media information (movie titles, series descriptions, posters, cast, and related metadata) sourced from third-party providers, including TMDB (The Movie Database) and TVDB. This content is provided for informational purposes only.
We do not claim ownership of third-party media content. The availability and accuracy of this information depends on our third-party providers. We are not responsible for errors, omissions, or changes in third-party media data.
8. Subscriptions (Screend Pro)
8.1 Overview
The Service offers an optional paid subscription ("Screend Pro") that unlocks additional features. Screend Pro is billed as an annual subscription.
8.2 Payment processing
All subscriptions are purchased and billed through the Apple App Store or Google Play Store. We do not collect or store any payment information. All billing, payment processing, and refunds are handled entirely by Apple or Google and are subject to their respective terms and refund policies.
8.3 Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
8.4 Cancellation
You may cancel your subscription at any time through your device's subscription management settings (Apple ID settings on iOS, Google Play Store on Android). Cancellation takes effect at the end of your current billing period. You will continue to have access to Pro features until then.
8.5 Price changes
Subscription prices and features may change. We will provide notice of material price changes before they take effect. Apple and Google may also notify you directly before any price change applies to your renewal.
8.6 Refunds
Refund requests must be submitted directly to Apple or Google through their respective support channels, as they handle all payment processing.
9. Intellectual Property
The Service, its design, features, code, and original content (excluding User Content and third-party media data) are owned by Screend and protected by applicable intellectual property laws. The Screend name, logo, and branding are our trademarks.
You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service without our prior written permission. Your use of the Service does not grant you any ownership rights in the Service or its content.
10. Copyright and Takedown Requests
We respect intellectual property rights. If you believe any content on the Service infringes your copyright, you may submit a takedown request to [email protected] with the following information:
- A description of the copyrighted work you claim has been infringed
- A description of where the infringing material is located in the Service
- Your contact information (name, email, address)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
- Your physical or electronic signature
We will respond to valid takedown requests in accordance with applicable copyright law, including the US Digital Millennium Copyright Act (DMCA) and EU Directive 2019/790.
11. Service Availability
We strive to keep the Service available at all times but do not guarantee uninterrupted, error-free, or secure access. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
We may modify, suspend, or discontinue any part of the Service at any time. If we make changes that materially reduce the functionality of the Service, we will provide reasonable notice when practicable. We are not liable for any losses resulting from downtime, modifications, or discontinuation of the Service, except as required by applicable law.
12. Account Termination
12.1 By you
You may delete your account at any time through the App's settings. Upon deletion, your data will be handled as described in our Privacy Policy.
12.2 By us
We may suspend or terminate your account if you violate these Terms, engage in behavior that is harmful to other users or the Service, or if required for security or legal reasons. Where practicable, we will provide notice and an explanation before taking action.
Upon termination, your right to use the Service ceases immediately. If your account is terminated for a policy violation while you have an active Screend Pro subscription, no refund will be provided for the remaining subscription period.
12.3 Survival
Sections 3 (User Content and License), 9 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), 16 (Feedback), and 19 (Governing Law) survive termination of these Terms.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee the accuracy, completeness, or reliability of any User Content, artist-submitted content, or third-party media information displayed in the Service. Such content is the sole responsibility of the person or entity that posted it.
We do not endorse, verify, or guarantee the identity or statements of any user of the Service.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Screend shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.
Our total aggregate liability for any claim related to the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) 50 euros.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law (including EU consumer protection law).
15. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Screend and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your User Content, or (d) your violation of any third party's rights.
This section does not apply to users located in the EU or UK to the extent that applicable consumer protection law prohibits such indemnification obligations.
16. Feedback
If you send us feedback, suggestions, or ideas about the Service ("Feedback"), you agree that: (a) we are under no obligation of confidentiality regarding your Feedback, (b) we may already have similar ideas under consideration, and (c) you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate your Feedback into the Service without any obligation to you.
17. EU Consumer Rights
If you are a consumer located in the European Union or the European Economic Area, you benefit from mandatory consumer protection laws that cannot be overridden by these Terms. Nothing in these Terms affects your statutory rights, including:
- Your right to a 14-day cooling-off period for online purchases, as provided under the EU Consumer Rights Directive (though this right may be waived for digital content once streaming or download begins with your consent)
- Your right to a conforming service under EU consumer law
- Your right to lodge a complaint with the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, the Service, or legal requirements. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you through the App or by email
Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account. For users in the EU, we will provide at least 30 days' notice before material changes take effect.
19. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of France.
For users in the EU/EEA: any dispute shall be subject to the jurisdiction of the courts of your country of residence, in accordance with EU Regulation 1215/2012. You may also bring proceedings in France.
For users outside the EU/EEA: any dispute shall be subject to the exclusive jurisdiction of the courts of France.
Nothing in this section affects your right to bring a claim under mandatory consumer protection laws of your country of residence.
20. Child Safety
Screend has a zero-tolerance policy toward child sexual abuse and exploitation (CSAE) and toward any content or conduct that sexualizes, endangers, or exploits minors. Such content and behavior are strictly prohibited on the Service.
Prohibited material and behavior include, without limitation:
- Child sexual abuse material (CSAM) in any form
- Sexualization of minors, including in reviews, comments, lists, usernames, images, or links
- Grooming, solicitation, or any attempt to engage a minor in sexual or exploitative activity
- Sharing, requesting, or linking to content that exploits or endangers minors
Any account involved in such activity will be permanently banned and its content removed. We report confirmed child sexual abuse and exploitation to the relevant authorities, including the National Center for Missing & Exploited Children (NCMEC) and law enforcement in France and the European Union, as required by law.
Reporting
You can report content or behavior that exploits or endangers a minor at any time:
- Using the in-app report feature available on any profile, review, comment, or other content
- By emailing [email protected] with a description of the content and where it is located
We review all reports promptly and take appropriate action, which may include removing content, suspending or terminating accounts, and notifying the authorities.
